Please read the Terms and Conditions of LabradorAds.com “the Site” before using it and navigating on this web site. BY SUBMITTING INFORMATION to, or accessing information from, the Site, YOU, the end user customer ("User") AGREE TO THE FOLLOWING TERMS AND CONDITIONS. These Terms and Conditions are a legal agreement between you and LabradorAds.com. If you do not agree to these Terms and Conditions, do not submit information to, or access information from, the Site. Submission and Administration of Listings “Ads”
Users shall not submit any descriptions, photographs, financial, contact or other information ("Ads") to this web site unless (i) Customer has received all necessary rights and authorizations, including without limitation from the owner of the property listed, any necessary agents or brokers, and the author of the Ad including the photographer and/or copyright owner of any photographs, as applicable, to publish and advertise the Ads as part of the Service and allow the Ads to be accessed, downloaded and copied by users of this Service; and (ii) the Ad is accurate and Customer agrees to administer the Ad and maintain its accuracy at all times. Customer represents, warrants and covenants that the Ad is correct at the time of submission and will remain correct as long as the Ad is used in connection with this Site. (iii) The user shall not submit to this Site, including but not limited to description and photographs any material Illegal, threatening, abusive defamatory, obscene, pornographic, discriminatory or advertise with the intention of conducting illegal transactions or business of any nature. LabradorAds.com will, in its sole discretion, remove any Ads that are alleged to have been submitted in violation of this provision. In addition, LabradorAds.com may require additional evidence of compliance with this provision from customers who are alleged to have submitted Ads in violation of the terms of this provision on multiple occasions. LabradorAds.com will, in its sole discretion, terminate the accounts of, and refuse service to, Users who are repeat infringers.
Indemnity
Customer will indemnify and hold harmless LabradorAds.com, at customer's sole expense, against any claim, action, legal proceeding, damages, liability, settlements, expenses (including attorneys' fees) and other costs arising out of or relating to (i) breach of these terms and conditions, (ii) negligence or misconduct by customer or (iii) a claim that an Ad or other information provided by customer infringes the copyright, trademark, trade secret, patent or other proprietary right of a third party.
Warranty Disclaimers
The Ads and services on this Site are provided "as is" to the Users without warranty of any kind. LabradorAds.com makes no promises, representation or warranties, either express, implied, statutory, or otherwise, with respect to the Ads or Services, including their accuracy, operation, conformity to any representation or description, or the existence of any latent or patent defects, and LabradorAds.com specifically disclaims all implied warranties of merchantability, no infringement and fitness for a particular purpose.
Any sales, agreement, transaction or business resulting from Ads and or Services provided by LabradorAds.com is the sole responsibility of the parties involved in such transaction, and agreements between the users. The site will not be responsible, for any warranty, malfunction, misinterpretation or any other damaged resulting from such transaction or services provided by the users or any other publicity or content on this site including links to other sites.
Use of Information
Customer agrees to treat all information and content obtained from the Site as proprietary to LabradorAds.com. The Site does not ensure the accuracy of, endorse or recommend any Ads and Users use such Listings at its own risk. Customer may access the information contained in the Ads solely to obtain initial information from which further evaluation and investigation may commence. Users shall limit access and use of the Ads to personal and internal use, and shall not use Ads obtained from the Site for further distribution, publication, public display, or preparation of derivative works. Customer shall not use or reproduce Ads obtained from the Site for or in connection with any other listing service or device.
Other Rights of LabradorAds.com
Customer agrees that LabradorAds.com shall have the right to use Ads and other information submitted to it for any purpose, including without limitation for publication of all or part of such Ads on the World Wide Web for unrestricted use by Customers. LabradorAds.com shall have sole authority to choose the manner in which any Ad will be received, displayed and used by the Site, and reserves the right to remove all or any part of a Listing or refuse Services to anyone at any time in its sole discretion. LabradorAds.com shall have no obligation to (i) resolve disputes among users of the Site; or (ii) monitor or verify the accuracy or proper use of the Site by the Users.
Limitation of Liability
In no event shall LabradorAds.com have any liability for any indirect, incidental, special, or consequential damages, however caused and on any theory of liability, whether for breach of contract, tort (including negligence) or otherwise, arising out of or related to the Service or Ads, including but not limited to loss of anticipated profits, even if LabradorAds.com has been advised of the possibility of such damages. These limitations shall apply notwithstanding any failure of essential purpose of any limited remedy.
General
This is the entire agreement between the parties relating to the subject matter hereof and no waiver or modification of these Terms and Conditions shall be valid unless in writing signed by each party. The waiver of a breach of any term hereof shall in no way be construed as a waiver of any other term or breach hereof. If any provision of this Agreement shall be held by a court of competent jurisdiction to be contrary to law, the remaining provisions of this Agreement shall remain in full force and effect.
